In Article 9.12 (b) delete ‘elected according to their own procedures;’ and insert: ‘elected by all members of each State Party according to their own procedures’

In Article 10.2 (f) delete: ‘elected by its internal procedures’ and insert: ‘elected by all members of each State Party according to their own procedures’

In Article 11.2 (c) delete: ‘elected by its internal procedures’ and insert: ‘elected by all members of each State Party according to their own procedures’

In Article 15.2 (c) delete: ‘Party according to its internal procedures’ and insert: ‘elected by all members of each State Party according to their own procedures’

These changes to come into effect for vacancies after September 2028.


Applicability: Federal.


The existing text of the relevant sections of the Federal Constitution is as follows:

 

Article 9.12 

9.12 There shall be a Federal Council which shall consist of the following voting members: …… 

b. Three members from each State Party, elected according to their own procedures; 

 

Article 10.2 

10.2 The FPC shall consist of the following: …… 

f. One representative of each State Party, elected by its internal procedures (State Parties may appoint a substitute member should the elected member be unable to attend a specific meeting of the FPC). 

 

Article 11.2 

11.2 The Conference Committee shall consist of: 

i. Voting members:

c. one representative of each State Party, elected by its internal procedures (State Parties may appoint a substitute member should the elected member be unable to attend a specific meeting of the FCC); 

 

Article 15.2 

15.2 The Committee shall consist of: 

i. Voting members: …… 

c. one person elected by each State Party according to its internal procedures;
